Hidamari Town Terms of Service

These Terms are an agreement between you and Acorn Talk LLC, a Connecticut limited liability company ("Acorn Talk," "we," "us," or "our"), about the game Hidamari Town (ひだまり町), its updates, and its online features (the "Game").

Tango, Lens, Acorn Talk accounts, and our website are covered by the Acorn Talk Terms of Service. Our Hidamari Town Privacy Policy explains how we handle information from the Game.

1. Agreement

These Terms apply when you install or play the Game. If you do not agree to them, do not play the Game. If you are below the age of majority where you live, a parent or guardian must agree to these Terms for you.

You get the Game from the App Store, Google Play, or Steam. That store's terms also apply. If you got the Game from Apple, Apple's Licensed Application End User License Agreement applies, and these Terms add to it where they are consistent with it. Apple, Google, and Valve are not parties to these Terms and are not responsible for the Game or its support.

2. Your license to play

We grant you a limited, non-exclusive, non-transferable license to install and play the Game for your own personal, non-commercial use on devices you own or control, as the store's rules allow. The license continues while you follow these Terms.

You may stream the Game and share videos and screenshots of it, including on channels that earn money, if you do not present them as official Acorn Talk material.

3. Ownership

We and our licensors own the Game, including its story, characters, art, music, voices, and software. Fonts and other separately licensed materials in the Game remain subject to their licenses. These Terms do not give you any other rights in the Game.

4. Rules

Do not:

  • copy, sell, rent, or distribute the Game or files from it;
  • extract the Game's art, audio, text, or other materials to use or share outside the Game;
  • interfere with our servers, or use the online features to send harmful or unlawful content; or
  • reverse engineer the Game, except as the law or a license for part of the Game allows.

5. Pairing, save sync, and Tango

Pairing the Game with an Acorn Talk account is optional and free. It lets you study the words you save in Tango, keep your saves online, and continue on another device. Your Acorn Talk account and Tango are subject to the Acorn Talk Terms of Service.

Online features need an internet connection and can be unavailable at times. The Game keeps your saves on your device as well, so you can play without them. We may change or end online features for technical, security, legal, or business reasons, with notice where the law requires it.

6. Feedback

If you send a feedback report or other feedback, you allow us to use it to fix and improve the Game, without payment to you. We will not publish your comments or pictures in a way that identifies you without your permission.

7. Purchases

If the Game or content in it is sold, the store that sells it handles payment under its own terms.

8. Warranties and liability

Nothing in these Terms limits mandatory consumer rights or liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.

Subject to those protections, the Game is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Game or its online features will be uninterrupted, free of errors, or compatible with every device, or that online saves can never be lost.

Acorn Talk LLC and its members, employees, contractors, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data, even if advised of the possibility. Their total combined liability for all claims arising from the Game or these Terms is limited to the greater of US $100 or the amount you paid for the Game in the 12 months before the first event giving rise to the claims.

These exclusions and limits do not reduce compensation that consumer law requires for reasonably foreseeable loss from our breach or failure to use reasonable care and skill.

9. Ending these Terms

You can end these Terms at any time by deleting the Game. We may end your license if you materially break these Terms, or suspend online features for abuse, security risks, or legal requirements. Sections 3, 6, 8, and 10 continue after these Terms end.

10. Governing law and disputes

Connecticut law governs, excluding conflict-of-law rules, subject to consumers' mandatory local protections. Disputes belong in competent Connecticut courts, except that consumers keep any mandatory local forum. You may contact us to seek an informal resolution; this does not restrict access to courts or regulators.

11. Changes and general terms

We may update these Terms and post the new effective date, giving notice and obtaining agreement where the law requires it. Changes do not apply to disputes that already exist.

We may transfer this agreement with the business if the successor assumes our obligations and your rights are not reduced. If a provision is unenforceable, the remainder continues. Failure to enforce a provision is not a waiver.
